La Asociación Miguel Bru, el CIAJ (Colectivo de Investigación y Acción Jurídica) y la familia de Darian Barzabal –asesinado por policías de la Comisaría 3 de Los Hornos el 10 de enero de este año- solicitaron a Hector Vogliolo, Fiscal General, que revise la decisión tomada por los fiscales María Laura Di Gregorio y Sergio Delucis – UFI N° 4- quienes dieron por finalizada la investigación sin haber hecho lugar a reiterados pedidos de prueba presentados por los abogados patrocinantes para avanzar con la investigación e imputar a los distintos funcionarios por delitos que se desprenden de la propia causa.
Además presentaron documentación sobre este caso ante el Centro de Protección de los Derechos de las Víctimas del Ministerio de Justicia, la Secretaría de Derechos Humanos y la Procuración General bonaerenses; y la Comisión por la Memoria para que dispongan los medios a fin de garantizar la debida investigación del crimen del joven.
Entre los puntos señalados por las organizaciones patrocinantes, se destaca que los fiscales no investigaron ni hicieron lugar a la imputación que hubiese correspondido ante el posible incumplimiento de los deberes de funcionario público, así como el posible encubrimiento por parte de quien se desempeñaba como ayudante de guardia, la oficial Mariana González, -encargada del libro de guardia la noche del crimen- ; el posible peculado y la supresión de instrumentos públicos por parte del jefe de turno - el teniente 1º Adrián Martínez- en relación al arma “plantada” a la víctima en el patrullero, así como la desaparición del sumario en que se formalizó la incautación de la misma; y la posible participación en el crimen de Darian de quien conducía el patrullero –ex Sargento Gutierrez- en el cual la víctima recibió el disparo en el cráneo de parte del ex sargento Santiago Regalía.
Ambas organizaciones le piden al fiscal Héctor Vogliolo que revise esa decisión que niega el derecho a llegar a la verdad a la familia de Darian y que beneficia directamente a los policías imputados.
El CIAJ y la Asociación Miguel Bru tienen como objetivo plantear personalmente su preocupación al fiscal general, a quien a mitad del corriente mes le pidieron una audiencia por otro caso, el de Daniel Migone, para exponerle la preocupación por la demora en la investigación desarrollada por la fiscal Leyla Aguilar.
Este joven fue asesinado en un calabozo de la Comisaría Novena de nuestra ciudad el 10 de noviembre de 2005. La versión policial afirma que Daniel se ahorcó dentro del calabozo con su campera de jean. Es la misma dependencia policial donde Miguel Bru fue torturado, asesinado y desaparecido el 17 de agosto de 1993.
Casos como el de Daniel Migone y Darian Barzabal son lamentables ejemplos de la falta de compromiso institucional por parte de aquellos funcionarios del Estado que dirigen las investigaciones y tienen el deber de velar por el cumplimiento de las normas.
El CIAJ y la Asociación Miguel Bru afirman que esta actitud favorece la impunidad policial, invita y propicia la reiteración de este tipo de hechos y resulta una clara muestra del deliberado perjuicio al que se somete a éstos casos, a fin de favorecer a los miembros de la fuerza policial involucrados.
Asimismo no descartan la posibilidad de solicitar el sometimiento a juicio político de quienes resultan los responsables de maniobras propias de un encubrimiento.
