Fue suspendida la fecha de juicio en la causa contra el policía Luján Martínez. Debía comenzar el día siete de mayo, pero ante la renuncia de sus defensores, debió darse marcha atrás.A fines de abril la Asociación Miguel Bru (AMB), patrocinante de la causa que se sigue por la muerte de Mauro Martínez, pidió ante el Tribunal Oral Nro I que sean unificadas las causas donde se investigan a los dos oficiales involucrados en el gatillo fácil contra uno de los testigos del caso de Miguel Bru. Mauro Martínez “El Beto”, fue testigo de la desaparición de Miguel en agosto de 1993. Su testimonio fue fundamental durante el juicio de la causa Bru. A partir de ese momento comenzó a ser hostigado por la policía hasta que finalmente en junio de 2002, en un supuesto enfrentamiento armado lo asesinaron. Por este caso se dictaron las detenciones de dos agentes policiales; Luján Martínez, quien fue detenido de inmediato confesando que él mismo había sido quien efectuó el disparo y el oficial Gauna, quien estuvo prófugo durante años, hasta que a mediados de 2007 fue detenido en el barrio El Churrasco.
La detención de Gauna fue realizada en el marco de una investigación que fue separada por la Fiscalía de la causa contra Luján Martínez, que en ese momento ya había sido elevada a juicio y tenía fecha de debate oral para el siete de mayo de este año. Así, los agentes fiscales tomaron declaración a Gauna, dictaron la prisión preventiva, y la elevaron a juicio en un trámite separado del antes mencionado.
Esta semana fue suspendido el debate en la causa que se le sigue al policía Luján Martínez, decisión motivada por la renuncia de los abogados defensores del oficial. Se espera ahora una nueva fecha. Para Rosa Schonfeld de Bru, esto podría ser positivo; “nos da la posibilidad de seguir tratando de incorporar al otro imputado (Gauna) en la misma causa para que él también sea juzgado”.
Como se dijo en ediciones anteriores, a la Asociación Miguel Bru le sobran motivos para pedir la unificación de estas causas: se evitarían sentencias contradictorias y/o futuras nulidades, se evitaría también la ventilación de pruebas - con el consecuente riesgo de arruinarlas. No unificarla aumentaría el dispendio judicial, pues habrá que hacer dos juicios, con declaraciones de incompetencia en el camino, molestias a los testigos y peritos entre otros, y sin dudas, dificultaría la búsqueda de verdad para todas las partes.
