El pasado lunes 17 del corriente se presentó ante el Juez a cargo del Juzgado de Garantías Nro.3 el Dr. Néstor De Aspro una solicitud para que analice la posibilidad de declarar nula la resolución dictada por el Fiscal General Vogliolo que deniega la revisión del cierre de la investigación que se sigue por el asesinato de Daniel Oscar Migone producido hace tres años en la comisaría 9ª de La Plata.Por medio de esta resolución tomada por el Fiscal General se está denegando la revisión del cierre de la investigación que dispusieran los fiscales Martini y Berlingieri. Ambos tomaron esta investigación luego de que la familia de Daniel y sus patrocinantes, el Colectivo de Investigación y Acción Jurídica (CIAJ) y la Asociación Miguel Bru (AMB), recusaran a la Fiscal Leila Aguilar a comienzos de este año, por considerar que todo su accionar favorecía a la impunidad policial. Tras algunas semanas de estar al frente de la causa, los Fiscales pidieron la detención de un Oficial y la elevaron a juicio sin disponer una sola de las medidas de prueba reclamada.
La resolución de Vogliolo de no rever la medida de la elevación a juicio no da suficientes explicaciones y se contradice con lo actuado por el propio Fiscal General quien en el mes de febrero, cuando la causa aun estaba a cargo de Aguilar, ordenó de trámite que se considerasen los pedidos de pruebas que las organizaciones y la familia de Migone pedían, y que ahora sostiene que no son necesarias.
Tanto el CIAJ como la AMB sostienen que la vinculación de cinco funcionarios al proceso, no necesariamente supone que se haya accedido a la verdad. En este sentido, lo que se viene reclamando es que se investigue el posible secuestro de Daniel. Existen cada vez más elementos para sostener que Migone no solo fue víctima de torturas seguidas de muerte, sino que su permanencia en la comisaría, la noche del 10 de noviembre de 2005, fue posible tras una causa armada por la misma policía, y que el retiro del cadáver una vez ocurrido el asesinato solo tuvo como objeto desarmar la escena del crimen para encubrirlo.
Por último, también se pone en crisis la resolución de Vogliolo, porque no investigar delitos de acción pública para quienes están obligados a hacerlo, supone un apartamiento de las normas que regulan el proceder de estos funcionarios. La familia de Migone se presentó durante los últimos dos meses en cuatro oportunidades para hablar personalmente con el Fiscal General, pero no fueron recibidos.
A entender de las organizaciones, esta forma de operar de la justicia en las investigaciones en la que se involucra personal policial en la comisión de un delito es sistemática. No solo ocurre en la causa Migone sino en gran parte de las causas por gatillo fácil: los Fiscales hacen oídos sordos a los pedidos de pruebas de las partes damnificadas y sin disponer de una sola medida detienen a algunos de los oficiales mas comprometidos y ordenan el cierre de la causa, garantizando así la impunidad de muchos otros.
